THE AGENCIES |
BACKGROUND The City of High Point built Kersey Valley landfill in our residential area. Experiences living next door to it showed it was a disasterous siting error. Although shoddy operations brought inhuman conditions to residents. High Point officials arrogantly dismissed all substantive complaints. So, we collected data to present to NC DENR Solid Waste officials, trusting that state officials would be appalled to learn about what was going on and take decisive action. THIS DID NOT HAPPEN. Instead, these officials hunkered down and denied everything. When we persisted, they called in an AG lawyer and insisted everything was fine.UNDER OATH AND IN COURT BEFORE A JUDGE Curiously, NC DENR officials didn't encourage Solid Waste officials to seriously listen and respond to the public and to enforce its laws with the same vigor and concern to protect the environment and the public as is found in the present and past examples of other Department agencies and programs below: |

HOW ABOUT IF THEY JUST FIX THINGS NOW? -- Fixes are certainly welcome but, by now, belated good deeds alone cannot and do not atone for the years of inhuman, illegal conditions leading down the trail of humiliation citizens have been forced to walk because of planning and engineering blunders; failed operation, inspection, and enforcement methods; stubborn and selfish official CYA denials; and lack of substantive official remedial action or punishment appropriate to show they really mean it. Year upon year of sinking deeper and deeper into lost trust and credibility cannot be erased quickly. |

The Eighth Amendment and Collateral Damage. A convicted felon exposed to live under the conditions shown on thedumpsite would have attorneys from organizations clamoring about violation of the Eighth Amendment's "cruel and unusual punishment" clause. But these folks don't qualify for that attention because they have done nothing except live here all their lives... many years before the dump arrived. Who speaks for them? Who is their advocate? Who intervenes in their behalf? Who puts their foot down and brings this domestic human rights abuse to a STOP? |
The images and cites on thedumpsite will not soon be forgotten by those who endured them. Nor will instances when cries for help were ignored and, at times, even belittled by officials. Times when CYA replaced common sense and legal techno babble replaced rational thought. BUT WE CAN SUGGEST A START -- Before healing can even begin, intelligence insulting, knee-jerk denials, rationalizations, and excuses must be stopped. Agency officials should do the right thing, what should've been done long ago. publicly and openly admit, accept responsibility for, and sternly correct this obscene outrage as well as ensure it happens, NEVER AGAIN. |
